What is the LESLI?
LESLI stands for List of Eligible Surplus Line Insurers, which is issued by most US States' Insurance Commissioners/Directors. This list provides the names of companies that have been verified and endorsed by a State to become eligible to write Surplus Lines Insurances. The stipulations to figure on the list vary from State to State. In some cases, regulatory bodies demand that the acquired insurance policy be supplied by an insurance company that is either rated or figures in the LESLI. At present, Sinclair does not appear in any LESLI.

What is a Minimum Earned Premium (MEP)?
For certain insurance coverage we stipulate that "This coverage is subject to the 'Minimum Earned Premium' (MEP)," and we indicate the amount of the MEP. This is not an indication of a surcharge or an amount that will be added to your quoted premium.
It only means that if, for any reason, you cancel your policy the minimal charge of cancellation will be the amount of the MEP.
For example: if your annual premium is $1,200.00 with a calculated MEP of $500.00 and after 1 month you decide to cancel your policy, you will be charged for an MEP of $500.00. This applies even if your monthly premium payment before cancellation was $100.00 ($1,200.00 divided by 12 months).

I need a copy of my Certificate of Liabiliy. How do I get it?
In order to have access to your Certificate of Liability, visit the website and click on Login. Enter user name and password, which will take you to "Account Management." On the side of the screen you will see "Manage Your Account." Click on the link "Issue a Certificate of Liability." You are able to view and print the certificate at your convience.

How do I add an Additional Insured?
After you make a premium payment, you are entitled to issue Certificates of Liability and add Additional Insureds to your policy (refer to the terms for doing so at the website). Please go to our website and click Log In. If you are a new customer, you can then apply for your personal password, which will enable you to access your personal account in our secure customers area. You will receive your password via return e-mail. Then, using the password that we provide and your e-mail address, you can log in to your personal account and issue Certificates of Liability and add Additional Insureds to your policy.

Who Can Be Added To My Professional Liability Policy As "Additional Insured?"
Anyone who is an "interested party" can be added to your Professional Liability Policy as "Additional Insured."
This includes employers, landlords, institutions, governing bodies, state and municipal authorities.

Does the Architects and Engineers policy comply with minimum defence costs requirements as common in Australia?
Some registration boards in Australia require minimum of AUS$ 200,000.00 or 20% of sum insured for defence costs, as well as at least one automatic reinstatement in case of paid loss or claim. Upon request, we issue an endorsement for Architects and Engineers residing in Australia certifying these minimum requirements. This endorsement is issued at no further cost to the insured.

What is Sinclair status in Australia?
As of July 01, 2008 DOFIs (Direct Offshore Foreign Insurers) are required to be authorized in Australia by APRA (Australian Prudential Regulation Authority). There are limited cases in which Australians can place insurance covers with Offshore insurers. APRA published these cases ("Limited Exemptions"), and they include "Atypical Risks".
APRA recognises that there are a number of limited specific atypical insurance risks that currently cannot be placed, on a stand-alone basis, with authorised insurers.
They apply to the following lines of insurance:
Nuclear
War
Terrorism
Satellite or space
Biological risk
Medical clinical trials
Aviation liability, and
Shipowners protection and indemnity other than for pleasure crafts.
The insured will self-assess against this list of insurance lines. If the insured is seeking a policy that corresponds to one of these lines, the business could then be placed with a DOFI without the DOFI being in breach of the prohibitions.
Sinclair accepts these types of covers from Australian customers and brokers.

Please notify us in writing, and we will cancel your policy and confirm the cancellation via return e-mail.

Do I have to pay A fee for cancellation?
We will give you 14 days to review your insurance plan. If for any reason you are not completely satisfied with your insurance coverage, simply notify us by email or fax, or inform us of your decision by filling out the online Contact Form within 14 days of receiving your Policy Declaration, and we will cancel the Policy with no penalty to you.

When a policy needs to be adjusted and it concerns the Insurance Limit, please contact us via e-mail with the details. We will then adjust the amounts. When such a change occurs the Premium is affected as well as the Deductible. We will contact you with the changes and, if you agree, we will issue an Endorsement to the Policy.

When a claim comes up who will handle it?
First please notify us of your claim (or even of an event that may result with a claim), and we will decide whether to handle it directly or to appoint a nearby professional to handle your claim. There are some practitioners who ask us: the UK regulators are going to enforce the EU regulations regarding the percentage of materials used for teethwhitening, and therefore all those practitioners who are using these materials are breaking the law. We offer cover for the use of these materials, and at the same time require that the practitioners work only legally.
We deal with this as follows:
[1] The policy is made to address the needs of practitioners in multiple jurisdictions and territories. Regulations are different in these areas, and in some of them these materials are legal for use.
[2] In many locations, the allowance to use certain products is different if administered by an MD (like a dentist), a nurse or a beauty expert (such as a cosmetician).
[3] We also understand that the market practice in some places is different than the official regulations, but those regulations are either not yet in place and are actually only a recommendation or a position of the regulators, or regulators tend to "Look the other way" although many practitioners are using these products in the open.
We therefore cover the use of practices that are common and not yet required to be ceased, as the legal status is that these materials are in fact legal, as long as the regulator is not enforcing the regulations it adopted.

Can you provide clarification regarding Beyond White Products?
Beyond White consumable products bear CE medical mark Class IIA under EEC medical directive via RULE 12 of Medical Device Directive, which has been further confirmed by EU notified bodies: first by Emergo Group in the Netherlands and later by MedCert Gmbh and Medical Device Safety Service Gmbh (both located in Germany). This is a German interpretation of the MDD and may differ from the views of individual countries' ministries of health. All Beyond White products have a CE mark followed by the 4 digit code. Beyond White products are therapeutic medical devices, not cosmetics and are registered with many of the EUs ministries of health.
Each EU country has a different regulatory system, as for the EEC Medical Devices Directive. However, if a device is successfully registered by an EU-notified body, in any of the member countries, it is as if it were registered in every member country. There are still many contradictions and each country may have its own interpretation of such legal issues. While the situation in Germany, for example, has been clarified by a final court ruling, in other countries the products may have no regulatory regime and if they are sold as cosmetics they are not allowed due to the low percentages permitted in the cosmetic directive. In the UK, a final court ruling has been handed down stating that the products are not medical devices, but the decision is based on home-use products. The cosmetics directive defines the percentage as 0.1%, being the maximum limit for cosmetics, but the cosmetics directive was written years ago, and there are those who interpret the limit as being for oral hygiene products such as toothpaste and mouthwash and not professional products. The Medical Devices Directive does not have any limitation regarding the concentration of hydrogen peroxide in tooth whiteners.
Some Beyond White products are classified as "therapeutical" medical devices, either Class I or Class IIA, depending on the product.

[4] We are faced with many inquiries asking if the use of these emulsions is legal, and if we do cover the treatment provided, using these emulsions.
We would like to clarify this issue:
[1] There are many countries where these emulsions are totally legal, and the local regulations in those countries allow the use of these products with certain restrictions. Moreover, the companies mentioned herein Beyond WhiteSpa and WhiteScience are recognized manufacturers, complying with the regulations valid in their countries including USA and more.
[2] Our policies clearly state that any conduct of illegal activity (treatment or practice, or use of illegal products) is totally prohibited, and will not be covered under our policies.
[3] The main question is: are these products illegal? Is treating people with these products, although the regulations might state differently, illegal?
[4] We do not address this question lightly. However, this document should not be taken as legal advice or a recommendation, it is purely our position in this matter. Therefore, WE STRONGLY SUGGEST YOU WILL TAKE LEGAL ADVICE BEFORE MAKING A DECISION AS TO THE USE OF QUESTIONABLE PRODUCTS.
[5] As an insurer, we cover treatments using Beyond WhiteSpa products and WhiteScience products, and our policies provide professional indemnity cover to their holders.

Do your policies cover product liability?
Our policies offer Professional Liability and not Product Liability, however, we do offer defence of claims - limited to 5% of the cover - for alleged use of faulty products. Therefore, we recommend that the use only of materials that have been obtained from reputable, traceable companies, the ingredients of which are easily identified on the product label, so that any claim of use of faulty material will be placeable on the manufacturer's liability.

There are some practitioners who ask us: the UK regulators are going to enforce the EU regulations regarding the percentage of materials used for teethwhitening, and therefore all those practitioners who are using these materials are breaking the law. We offer cover for the use of these materials, and at the same time require that the practitioners work only legally.
We deal with this as follows:
[1] The policy is made to address the needs of practitioners in multiple jurisdictions and territories. Regulations are different in these areas, and in some of them these materials are legal for use.
[2] In many locations, the allowance to use certain products is different if administered by an MD (like a dentist), a nurse or a beauty expert (such as a cosmetician).
[3] We also understand that the market practice in some places is different than the official regulations, but those regulations are either not yet in place and are actually only a recommendation or a position of the regulators, or regulators tend to "Look the other way" although many practitioners are using these products in the open.
We therefore cover the use of practices that are common and not yet required to be ceased, as the legal status is that these materials are in fact legal, as long as the regulator is not enforcing the regulations it adopted.

Beyond White consumable products bear CE medical mark Class IIA under EEC medical directive via RULE 12 of Medical Device Directive, which has been further confirmed by EU notified bodies: first by Emergo Group in the Netherlands and later by MedCert Gmbh and Medical Device Safety Service Gmbh (both located in Germany). This is a German interpretation of the MDD and may differ from the views of individual countries' ministries of health. All Beyond White products have a CE mark followed by the 4 digit code. Beyond White products are therapeutic medical devices, not cosmetics and are registered with many of the EUs ministries of health.
Each EU country has a different regulatory system, as for the EEC Medical Devices Directive. However, if a device is successfully registered by an EU-notified body, in any of the member countries, it is as if it were registered in every member country. There are still many contradictions and each country may have its own interpretation of such legal issues. While the situation in Germany, for example, has been clarified by a final court ruling, in other countries the products may have no regulatory regime and if they are sold as cosmetics they are not allowed due to the low percentages permitted in the cosmetic directive. In the UK, a final court ruling has been handed down stating that the products are not medical devices, but the decision is based on home-use products. The cosmetics directive defines the percentage as 0.1%, being the maximum limit for cosmetics, but the cosmetics directive was written years ago, and there are those who interpret the limit as being for oral hygiene products such as toothpaste and mouthwash and not professional products. The Medical Devices Directive does not have any limitation regarding the concentration of hydrogen peroxide in tooth whiteners.
Some Beyond White products are classified as "therapeutical" medical devices, either Class I or Class IIA, depending on the product.

There are some practitioners who ask us: the UK regulators are going to enforce the EU regulations regarding the percentage of materials used for teethwhitening, and therefore all those practitioners who are using these materials are breaking the law. We offer cover for the use of these materials, and at the same time require that the practitioners work only legally.
We deal with this as follows:
[1] The policy is made to address the needs of practitioners in multiple jurisdictions and territories. Regulations are different in these areas, and in some of them these materials are legal for use.
[2] In many locations, the allowance to use certain products is different if administered by an MD (like a dentist), a nurse or a beauty expert (such as a cosmetician).
[3] We also understand that the market practice in some places is different than the official regulations, but those regulations are either not yet in place and are actually only a recommendation or a position of the regulators, or regulators tend to "Look the other way" although many practitioners are using these products in the open.
We therefore cover the use of practices that are common and not yet required to be ceased, as the legal status is that these materials are in fact legal, as long as the regulator is not enforcing the regulations it adopted.

Practitioners Using Beyond WhiteSpa and WhiteScience Products:
[1] The UK and EU health authorities define the maximum concentration allowed for various treatment emulsions.
[2] Although one can expect the concentration levels to be different when referring to process of use and treatment (self-use, administration by professionals or by medical practitioners) or sale method (over the counter available to general public, only to clinics, etc) there are no clear specifics that can clarify this issue.
[3] It is the market practice and very common, to find both locally manufactured emulsions and imported emulsions that go far beyond the levels of concentration stated in the UK and EU regulations, which can be understood by the general public AND by many practitioners that if the customs authorities allowed the import or the health authorities do not act against those who manufacture or import these emulsions that they are legal in fact for use.
[4] We are faced with many inquiries asking if the use of these emulsions is legal, and if we do cover the treatment provided, using these emulsions.
We would like to clarify this issue:
[1] There are many countries where these emulsions are totally legal, and the local regulations in those countries allow the use of these products with certain restrictions. Moreover, the companies mentioned herein Beyond WhiteSpa and WhiteScience are recognized manufacturers, complying with the regulations valid in their countries including USA and more.
[2] Our policies clearly state that any conduct of illegal activity (treatment or practice, or use of illegal products) is totally prohibited, and will not be covered under our policies.
[3] The main question is: are these products illegal? Is treating people with these products, although the regulations might state differently, illegal?
[4] We do not address this question lightly. However, this document should not be taken as legal advice or a recommendation, it is purely our position in this matter. Therefore, WE STRONGLY SUGGEST YOU WILL TAKE LEGAL ADVICE BEFORE MAKING A DECISION AS TO THE USE OF QUESTIONABLE PRODUCTS.
[5] As an insurer, we cover treatments using Beyond WhiteSpa products and WhiteScience products, and our policies provide professional indemnity cover to their holders.

Can you provide clarification regarding Beyond White Products?
Beyond White consumable products bear CE medical mark Class IIA under EEC medical directive via RULE 12 of Medical Device Directive, which has been further confirmed by EU notified bodies: first by Emergo Group in the Netherlands and later by MedCert Gmbh and Medical Device Safety Service Gmbh (both located in Germany). This is a German interpretation of the MDD and may differ from the views of individual countries' ministries of health. All Beyond White products have a CE mark followed by the 4 digit code. Beyond White products are therapeutic medical devices, not cosmetics and are registered with many of the EUs ministries of health.
Each EU country has a different regulatory system, as for the EEC Medical Devices Directive. However, if a device is successfully registered by an EU-notified body, in any of the member countries, it is as if it were registered in every member country. There are still many contradictions and each country may have its own interpretation of such legal issues. While the situation in Germany, for example, has been clarified by a final court ruling, in other countries the products may have no regulatory regime and if they are sold as cosmetics they are not allowed due to the low percentages permitted in the cosmetic directive. In the UK, a final court ruling has been handed down stating that the products are not medical devices, but the decision is based on home-use products. The cosmetics directive defines the percentage as 0.1%, being the maximum limit for cosmetics, but the cosmetics directive was written years ago, and there are those who interpret the limit as being for oral hygiene products such as toothpaste and mouthwash and not professional products. The Medical Devices Directive does not have any limitation regarding the concentration of hydrogen peroxide in tooth whiteners.
Some Beyond White products are classified as "therapeutical" medical devices, either Class I or Class IIA, depending on the product.

Do you offer this coverage in the USA only or also in other countries?
We do not offer our Therapists' Liability Insurance to US customers - but to all worldwide internet surfers.
We welcome customers and applicants from all countries, including US, Canada, the United Kingdom, Australia, and many other countries. However, if you fail to find your country or state/province in our quoting or application system, it is probably because we do not accept customers who are residents of that country or state/province (This is the case for most US States).
